​1. Introduction

These Terms and Conditions govern the presentation and potential sale of artworks through the website of Nia Gallery, operated by: ARTMY PROJECT s.r.o.

The website may include a section presenting artworks available through the gallery.

This section functions primarily as an online viewing room and catalogue of available artworks.

The display of artworks on the website does not constitute a binding offer to conclude a purchase contract within the meaning of the Czech Civil Code.

 

2. Availability of artworks

All artworks are unique pieces and are therefore subject to availability.

Due to the nature of the art market, an artwork may already be reserved or sold at the time of inquiry.

The gallery reserves the right to update information regarding:

  • availability

  • pricing

  • description of artworks

All information presented on the website is informational only.

 

3. Colors and visual representation disclaimer

Images of artworks on the website are intended for illustrative purposes.

Actual colors, textures and details may vary slightly due to:

  • screen settings

  • lighting conditions

  • photographic reproduction

The gallery does not guarantee exact color accuracy.

Collectors are encouraged to contact the gallery for additional images or condition details.

 

4. Condition of artworks

Artworks may include minor characteristics consistent with the nature of original artworks.

5. Purchase process

A purchase agreement is concluded only after:

  • confirmation of availability

  • agreement on price

  • agreement on payment terms

  • agreement on delivery method

The gallery will confirm the transaction via written confirmation or invoice.

 

6. Pricing and payment

Payment methods may include:

  • bank transfer

  • other individually agreed methods

The gallery may require full payment prior to delivery.

Prices may be subject to VAT according to Czech and EU legislation.

 

7. Shipping and delivery

  • delivery location

Possible delivery options include:

  • personal collection at the gallery

  • courier service

  • professional art transport

Shipping costs may be charged separately.

The risk of damage transfers to the buyer upon receipt of the artwork, unless otherwise agreed.

 

8. Right of withdrawal (consumer purchases)

If the buyer is a consumer and the purchase agreement was concluded remotely (e.g. online or by email), the buyer has the right to withdraw from the contract within 14 days from receiving the artwork in accordance with applicable consumer protection laws.
 

To exercise this right:

  • the buyer must notify the gallery within the 14-day period

  • the artwork must be returned in original condition
     

The buyer is responsible for:

  • safe packaging

  • return shipping costs

  • any reduction in value resulting from handling beyond what is necessary to inspect the artwork.

 

9. Returns

Returned artworks must be:

  • undamaged

  • in their original condition

  • properly packaged

Refunds will be processed after the artwork has been inspected by the gallery.

 

10. Intellectual property

The purchase of an artwork transfers ownership of the physical object only.

Copyright and all intellectual property rights remain with the artist.

The buyer may not reproduce, publish or commercially exploit the artwork without the artist's permission.

 

11. Limitation of liability

The gallery is not liable for indirect damages related to the use of the website.

The gallery strives to ensure that all information on the website is accurate, but cannot guarantee the absence of errors.
